Need Help - Do Businesses who generate Forex income have to pay GST/HST to the CRA (Canada)
Hey guys, I'm a total noobie here and can't seem to find the answer to this question anywhere. In Canada, if you incorporate yourself and run your trades through your business and earn business income, do you also have to pay GST/HST to the CRA as another business would? I am asking this question because for my current job, I am incorporated (different field) and charge GST/HST, which then goes to the CRA. However, seeing as this is Forex, would it be the same? It's not like you can collect GST/HST from the market....lol Essentially I'm trying to see what is the best option to save my profits going forward. This scenario is based on generating 500K/year in profit via trading:
Claim Capital Gains - 50% of the profit will be taxed at your marginal rate (Until how long though? At what point will the CRA consider it business income instead?)
Sole Proprietor - Income is taxed at the personal income tax rate and you can also claim expenses, in addition you do not pay GST/HST
Incorporated Business - Income is taxed at the corporate tax rate, you can claim expenses and pay yourself dividends (even lower tax rate), BUT - Do you have to pay GST/HST as well?
Sorry for the stupid question, the answer is probably no, but I want to be sure. If I don't have to pay GST/HST then I think registering as a business is a no-brainer. In fact, you can save more money than purely capital gains up to a certain point. Not to mention all the tax-hacks you can have like using the business' money to buy yourself a home completely tax-free in Canada, if you know how to do it. Essentially I'm seeing the best way to pay myself 100K/year while saving the other 400K, to then take it out tax-free on a future home. But yeah, do businesses have to pay GST/HST? Thanks everyone.

I would be travelling to Europe for a week. I read online that for every transaction I do with my card there is a charge of 3.5% + 18% GST on that. That would be a lot considering the amount would be in Euros. What card do use while travelling abroad?

Friend will be flying out of India. He is using ICICI debit card. How much would be the transaction charges? ICICI says it will be 3.5% + 18% GST. This means if someone spends 100 USD, then he will need to shell out 21.5 USD additionally only as charges. That's crazy insane. Can someone confirm if it's true? He called up twice, the second time the lady told him that the 18% will be on 3.5% i.e. a total of 4.13% charge will be levied. However in NZ the NZ distributor effectively imports at US RRP, then does markups from there. Which just doesn't seem right, but, well, we've got the buying power of a gnat. However given our fellow brothers and sisters in Australia aren't happy about it, I thought I'd put a post up in the genuine hope that maybe some others would provide some data and we can either go "hmm that's a little fishy" or "oh, that's just an anomaly, as you were". So for background, I've never in the past felt pricing of computer parts were off relative to US RRP in NZ except for really weird odd ball items. I've lived in Canada, and moving back to NZ I was really sensitive to "oh, prices in NZ must be terrible" which was actually not true - when you did exchange rate conversions with tax it generally works out pretty close (NZ sticker prices include tax, vs Canada/US prices exclusive of tax) However something doesn't seem right with the RTX cards. So I went back into the past, when I got a 1080TI and compared some numbers. May 2017 Forex rate 0.70 Gigabyte Aorus GTX 1080 TI 11G edition. Tax on Foreign Exchange Conversion Service under GST
The implementation of GST (Goods And Service Tax) on July 1, 2017 has revised the tax structure of transactions on several goods and services, including forex services in India. The revised rates for forex servicescome as a welcome move as the taxes often lie between 0.05% to 0.18% of the total forex transaction. When partaking in any kind of foreign exchange services like currency exchange, money transfer, or buying a forex card, one is only expected to pay the GST; and as per the directive from the Government of India, one is expected to pay 18% on the forex transactions that comes under the taxable value bracket. So what is “taxable value”? Taxable value is the set portion of the transaction upon which tax is levied. This reduces the amount of tax one has to pay on forex services greatly. Currently the government has set up 3 slabs of taxable value, based on the amounts of transactions. Slab 1: Up To Rs. 1 Lakh: On forex transactions up to Rs. 1 lakh, the taxable value stands at 1%, and the minimum taxable value is at Rs. 250. Here 1% of Rs. 25,000 is Rs. 250. Thus for transactions up to Rs. 25,000, the taxable value is Rs. 250. 18% of this taxable value (Rs. 250) is a mere Rs. 45. Hence the minimum tax one has to pay in Slab 1 is Rs. 45. Similarly, the maximum payable tax is Rs. 180. Slab 2: Rs. 1 Lakh to Rs. 10 Lakh: In Slab 2, the taxable value is calculated as 1000 + 0.5% of the amount above 1 lakh. Considering the value of transaction to be Rs. 5 lakh, then Taxable value = 1000 + (0.5% * 4) = 1000 + 2000 = 3000 Actual tax = 18% of 3000 = Rs. 540. Similarly, calculating the lower limit (tax on Rs. 1 lakh transaction) and upper limit (tax on Rs. 10 lakh transaction), we get the lower and upper limit of taxes for Slab 2, which is Rs. 180 and Rs. 990, respectively. Indian Freelancers/Bloggers/etc. don't need to apply for GST Registration if turnover is less than 20 lacs
We all know that the newer GST laws are way more complex than they need to be, and if you ask this question to 10 people, then you will get 10 different answers. However, though this isn't stated anywhere officially or directly, an interpretation could be made for registration exemption for freelancers based on one of the following: Section 23(a) and the Threshold Limit for 20 Lacs turnover:
Section 23(a): any person engaged exclusively in the business of supplying goods or services or both that are not liable to tax or wholly exempt from tax under this Act or under the Integrated Goods and Services Tax Act;
OR
GST will apply when turnover of the business exceeds Rs 20lakhs (Limit is Rs 10lakhs for the North Eastern States)
You can easily get confused when you try to interpret the Section 23(a) or the threshold limit clause individually, but when you consider both, it becomes clear that as a freelancer with less than 20L income, you have to fall in either one of those categories. As per Section 23(a) (first clause), you are not required to register if you deal 100% in goods/services that are not liable to tax (highlighted for clarity). Since freelance export is a zero-rated service, the tax liability is essentially zero, so you are exempt for registration. However, some CAs are quick to point out that you cannot count your service as "export" unless you do some heavy-lifting compliance stuff like submit a Letter of Undertaking (LuT) or a Bond (or pay IGST and then get a refund), get paid in ForEx currency (get a FIRC from bank), etc. But the moment you say that, the second clause (threshold limit) kicks in! If its not an export, its not an inter-state transaction either, so the threshold limit clause of 20 lacs can exempt you of registration. A freelancer's sale or service cannot be both an inter-state transaction, and not an export. Thus, if you consider both the above laws individually, you might get confused and think that registration is mandatory. But if you consider them in combination, you can reasonably interpret that registration is not mandatory for freelancers (and other small exporters) who have a turnover of less than 20 lacs per annum. Based on present interpretation of the GST law, the only way a small freelancer can be held liable for taxation is if his/her service is considered both inter-state and not an export (which is plain absurd). The only way this status can be overridden is more clarity and any more specific laws for freelancers by the GST council.

Export is treated as Inter-state supply under GST and IGST is charge on export. ‘zero rated supply’ (Sec.16 (1) IGST act) i.e. the goods or services exported shall be relieved of GST levied upon them either at the input stage or at the final product stage. GST will not be levied in any Kind of Exports of Goods or Services.
